These Terms of Service ("Terms") govern your access to and use of the NOVANESTFS website, guides, research materials, accounts, memberships and related services provided by NovaNestFS LLC ("NOVANESTFS," "we," "us," or "our"). By accessing or using a service, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility and authority

You must be legally able to enter into these Terms. If you use NOVANESTFS for an organization, you represent that you have authority to accept these Terms on its behalf. You must provide accurate information and comply with laws that apply to your use of the service.

2. Accounts and security

You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Do not share credentials, allow unauthorized access or attempt to use another person's account. Notify us promptly if you believe an account has been compromised. We may require email verification or other reasonable security steps before providing access or support.

3. Service and informational content

NOVANESTFS publishes source-linked consumer protection guides, topic descriptions and, when available, research materials or licensed datasets. Content is provided for general educational and informational purposes. It is not financial, legal or individualized security advice. We do not investigate fraud, report incidents on your behalf or guarantee recovery of funds. Verify information with the relevant institution or public agency.

Research descriptions do not promise that a particular dataset, update, file format or feature will be available. The scope, source, dates, permitted use and limitations stated with a published item form part of the conditions for using that item.

4. Memberships, billing and cancellation

If a paid membership is offered, the price, billing interval, included access, renewal terms, taxes and cancellation method will be presented before you authorize a charge. Access begins only after payment is confirmed and applies to the entitlements described for the selected plan or release.

If a checkout identifies a membership as automatically renewing, it will renew for the stated interval until cancelled. Unless different terms are displayed at purchase or required by law, cancellation stops future renewals and access continues through the paid billing period. Charges already incurred are handled according to our Refund and Cancellation Policy and applicable law.

5. SMS program

NOVANESTFS may offer recurring informational text alerts about consumer protection guides and fraud-awareness topics selected by the user. Enrollment requires a separate, affirmative SMS consent choice. SMS consent is optional and is not a condition of purchase or membership.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time or HELP for assistance. Carriers are not liable for delayed or undelivered messages. 6. Acceptable use

You may not:

Use the service for unlawful, fraudulent, infringing or harmful activity.
Attempt unauthorized access, probe security controls or interfere with the operation of the service.
Introduce malware, abusive traffic or automated requests that place an unreasonable burden on the service.
Reverse engineer software except where applicable law expressly permits it.
Share account credentials or bypass access, payment or usage restrictions.
Copy, resell, publish or redistribute restricted content or licensed files beyond the permission stated for that content.
Misrepresent NOVANESTFS content as government guidance or imply an affiliation that does not exist.

7. Content, licenses and intellectual property

NOVANESTFS and its licensors retain their rights in the website, original editorial content, data compilations, software, designs, documentation and trademarks. Subject to these Terms and any item-specific license, we grant you a limited, non-exclusive, non-transferable right to access and use the service for its intended purpose.

Original public records and third-party materials remain subject to the rights and terms of their respective publishers. A link to, summary of or inclusion of third-party material does not transfer ownership or expand your right to reuse it. You are responsible for reviewing the source and license information supplied with any research item or file.

8. Information you submit

You retain the rights you hold in information you submit to NOVANESTFS. You authorize us to process that information only as reasonably necessary to provide, secure and support the requested service, maintain required records and comply with applicable obligations. Our handling of personal information is described in the Privacy Policy.

9. Third-party services and links

The service may link to government resources, source publishers, payment processors or other third-party services. Those services operate under their own terms and privacy practices. NOVANESTFS does not control and is not responsible for third-party availability, content or conduct. Links are provided for reference and do not imply affiliation or endorsement.

10. Changes, suspension and termination

We may correct, update, suspend or discontinue content or features when reasonably necessary, including for security, legal, licensing or operational reasons. We may restrict or terminate access for a material violation of these Terms, misuse of the service or nonpayment. Where practical, we will provide notice appropriate to the circumstances.

11. Disclaimers

To the maximum extent permitted by law, the service and content are provided "as is" and "as available." NOVANESTFS disclaims warranties of merchantability, fitness for a particular purpose, non-infringement and any warranties arising from course of dealing or usage of trade.

We work to provide clear, sourced information, but we do not guarantee that content will always be complete, current or error-free; that access will be uninterrupted or secure; that a particular research item will remain available; or that use of the service will produce a particular financial or recovery outcome.

12. Limitation of liability

To the maximum extent permitted by law, NovaNestFS LLC and its service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, business opportunities or goodwill arising from or related to the service.

To the maximum extent permitted by law, NOVANESTFS's total liability for claims relating to a paid service will not exceed the amount you paid NOVANESTFS for that service during the 12 months before the event giving rise to the claim. For a free service, total liability will not exceed US $100. These limitations do not apply where prohibited by law and do not limit rights that cannot legally be waived.

13. Governing law

Unless applicable law requires otherwise, these Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Nothing in these Terms limits mandatory consumer protections or other rights that cannot be waived under applicable law.

14. Changes to these Terms

We may update these Terms as the service changes. The revised Terms will be posted on this page with a new "Last updated" date. When appropriate, we will provide additional notice before material changes take effect. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.
